L.A. City Councilmember, Paul Krekorian is the featured speaker, Saturday, May 12, 2012, at 10am in our Main Office, located at 621 South Westmoreland Ave in Los Angeles.

Koreatown Meeting

The Koreatown Meeting will be held on Wednesday, May 16, 2012, at 11am in our Main Office, located at 621 South Westmoreland Ave in Los Angeles.

Santa Monica Meeting

The next Santa Monica Monthly Meeting will be held on Wednesday, May 30, 2012 at 7pm. The meeting will feature Earthquake Insurance Expert, Bed Bug Specialist who uses Dogs, Attorney – Harry Floyd and Uncle Walt’s Tips.

Of course, a lucky raffle winner will receive a $300 gift certificate, generously donated by Carlson’s Appliances in Santa Monica.

The meetings are held at the Colorado Center Community Room, located at 2500 Broadway Avenue in Santa Monica. The meeting room is just across the street from Helen’s Cycle Shop.  Street and validated parking are available.

AAGLA State Legislator Breakfast: Reception in Review

Dear Jim,

Congratulations, Saturday’s event was a smashing success. Not a hitch. Everything went on so smoothly, the result of a superb organization.

The speakers were for the majority really outstanding. I most liked the double negative gentleman (from Orange County?): he was to the point.

Feuer suprised me for having come: I would never have thought he was a friend of our industry, and his speech in praise of himself did not show it very much either.

Main Office Meeting

The Main Office Meeting was held on Saturday, Sept. 10, at 10:00 a.m.  This month’s meeting featured L. A. Councilmember Bernard Parks, who discussed issues about and within the City of Los Angeles.

Santa Monica Meeting

The Santa Monica Meeting will be held on Monday, Sept. 26, 2011, at 7:00 p.m.

The meeting will feature a presentation about LLCs, by Jeff Unger; the new smoking ordinance, by the SM City Attorney’s Office; and new increased fees and carbon monoxide detectors, by the SMFD.

October 6th AAGLA Trade Show & Seminar Schedule – Don’t Miss It!

Eviction Liability & Service of Notice Wins

CALIF LANDLORD/TENANT LEGAL UPDATE

Munoz v. MacMillan
A landlord sued his tenant for unlawful detainer of commercial real property and won (G043402, 5/13/11 CA4/3). The judgment included a writ of possession. The landlord enforced the writ and took possession of the premises.

The tenant appealed and won. The unlawful detainer was retried and this time the judgment favored the tenant. The final judgment in the underlying action was silent with regard to possession of the premises and/or monetary restitution for the loss of the tenancy.

The tenant then instituted a new lawsuit against the landlord for breach of contract, in which she claimed the landlord breached the lease – by causing law enforcement officials to evict her in violation of the terms of the lease.

The Appellate Court ruled that a landlord can breach a lease by evicting a tenant using judicial processes when the unlawful detainer judgment relies on a writ of possession that is later reversed. The landlord is not subject to liability for damages by merely prosecuting an unlawful detainer action to judgment. Allowing such a claim without proof of malice and lack of probable cause contravenes the law of malicious prosecution. Nevertheless, the court said the landlord can be liable for breaching the lease, and, possibly, be required to provide restitution.

In an unlawful detainer action, a judgment in favor of the defendant tenants was reversed by the Appellate Court (Case No. B224040, CA2, Div. 2). It ruled that the trial court erred in ruling that the plaintiff failed to meet its burden to prove that it satisfied the service requirements of Code of Civil Procedure section 1162, service of the 3-Day Notice to Pay or Quit.

The Appellate Court found that the trial court improperly refused to admit a proof of service from a registered process server into evidence. It disagreed with the Trial Court, which thought the document was hearsay. But, because the 3-day notice was served by a registered process server, the proof of service should not have been excluded. And the provisions of Evidence Code section 647 should have been applied to establish a presumption that the facts set forth in the proof of service were true.
